Website Terms
These terms describe use of the PCTC website and provide general information about enrollment. Your signed membership agreement and participation documents govern the specific services you purchase, subject to applicable law.
1. Website purpose and operator
This website provides information about Port Chester Training Club, its programs, schedule, and enrollment options. Contact details appear below. The legal operator is Port Chester Athletics LLC d/b/a Port Chester Training Club.
Browsing this website does not, by itself, purchase a membership, authorize recurring payments, waive an injury claim, or grant permission to use your image.
2. Programs, schedules, and purchases
Review the selected plan's price, included services, eligibility, class capacity, booking rules, billing dates, term, and cancellation provisions before purchasing through PushPress. A reservation is subject to the availability and confirmation stated in the booking process.
We may adjust future class schedules or programming for staffing, safety, or operational reasons. Changes do not eliminate your contractual or statutory rights if purchased services become unavailable or substantially change. Contact us if website information and an enrollment offer differ; we will not use a general website disclaimer to override an agreed price or legally required remedy.
3. Membership billing and founding offers
Recurring billing requires a clear disclosure of the charge, frequency, applicable term, cancellation process, and any promotional-price transition, followed by affirmative consent. You must receive a retainable acknowledgment of those terms. This webpage is not a substitute for that enrollment process.
Memberships are month-to-month. Submit cancellation before your next billing date to stop the next renewal charge. The founding promotion does not create a one-year commitment. Statutory cancellation and refund rights remain available, including any applicable rights after renewal.
The founding membership is limited to the first 25 members and provides unlimited classes for $150 per month for the first year. After the first year, it converts to the regular Unlimited membership at $175 per month unless cancelled. Enrollment disclosures must identify the membership activation date, first billing date, and date the $175 rate begins, together with any legally required notices.
The $5 founding reservation payment is credited toward the first month's membership dues. It is nonrefundable except where a refund is required by law. A reservation payment alone does not authorize recurring membership charges; those charges require the applicable enrollment disclosures and affirmative authorization. This policy does not override statutory cancellation rights or remedies if contracted services are not provided.
4. Cancellation and refunds
Contact PCTC to submit a cancellation request by email, telephone, mail, or in person using the details below. Where enrollment is offered online, a working online cancellation method must also be available through the enrollment website. PCTC will not require an in-person visit merely because you enrolled online.
New York health-club law provides cancellation within three business days after receipt of the written contract, with covered payments refunded within ten business days. Additional cancellation rights can apply upon death, qualifying disability lasting over three months, a move more than 25 miles from a club operated by the seller, or discontinuance or substantial change of contracted services. Refund deductions, if any, must be permitted by law.
New York also protects cancellation of a monthly renewal within three business days after renewal and an annual renewal within fifteen business days. Required cancellation acceptance is due no later than three business days after notice. More favorable rights in your agreement remain available. Nothing here imposes a cancellation fee, advance-notice barrier, or blanket no-refund rule.
See New York General Business Law § 624. This summary does not replace the statutory notices required in your signed health-club contract.
5. Safe participation and minors
Exercise involves physical risks. Follow coaching and safety directions, use equipment as instructed, report hazards, and stop if you experience concerning symptoms. Website content is general fitness information, not medical diagnosis, treatment, or individual clearance to exercise. Consult a qualified healthcare professional when appropriate.
Participation may require a separate signed agreement acknowledging relevant risks and safety responsibilities. Adult paperwork applies only to adults and the activities it identifies. A parent or legal guardian must complete appropriate documents for a minor; an adult waiver cannot simply be reused as a youth release.
6. Media permission and privacy
Promotional use of identifiable member photographs, video, or audio is governed by the express media provisions in the applicable signed participation agreement. Those provisions are included under the same signature as participation permission; youth Athlete Performance requires an authorized parent or guardian to sign. Visiting this website or accepting these website terms does not itself grant media permission. See our Privacy Policy for information handling and contact options.
7. Appropriate website use and content
Use the website lawfully. Do not attempt unauthorized access, interfere with its operation, submit malicious material, impersonate another person, or misuse another person's information. PCTC branding and original website content, and third-party materials used with permission, remain subject to their owners' rights. You may view the site and share links; other uses requiring authorization must be cleared with the rights holder.
8. Third-party services
PushPress, payment providers, Google, Instagram, and other linked services have their own terms and privacy notices. Review them when you use those services. Links do not eliminate PCTC's responsibilities to you under its own agreements or applicable law.
9. Rights preserved; updates
Nothing in these terms releases PCTC from negligence where New York law prohibits that release, or limits liability for gross negligence, recklessness, intentional misconduct, or other nonwaivable claims. These terms contain no mandatory arbitration provision, class-action waiver, or obligation to reimburse PCTC for its own wrongdoing.
New York law governs to the extent permitted, without depriving you of mandatory protections that otherwise apply. If a provision cannot lawfully be enforced, the remaining provisions apply only as consistent with law. Future website revisions do not retroactively change purchased membership terms or authorize new charges.
10. Contact and cancellation requests
For a membership request, provide your name and enough information to identify your account. Do not email payment-card details or complete medical records. If you do not receive an acknowledgment, contact us again; lack of acknowledgment does not negate a timely request.
